Functional Pilates is committed to the personal privacy of its clients and staff, and complies with the Privacy Act 1988 and uphold the Australian Privacy Principles 2014 (APPs) and the privacy provisions of all applicable legislation. The APPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information. This includes information we have collected from people through our office, over the phone and over the internet.

Except as described in this Privacy Policy, Functional Pilates will not share, sell, or rent Personal Information with anyone without your permission or unless ordered by a court of law.

What is Personal Information and why do we collect it?

We collect personal information from an individual that is necessary to provide our service. This information can include your name, gender, date of birth, addresses, telephone numbers, email addresses, and emergency contacts. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect, such as newsletters, running competitions, email communication and for general studio communication, all related to information or health and safety issues.

You may unsubscribe from our mailing/marketing lists at any time by clicking the 'unsubscribe from this list' link at the bottom of any email campaign, contacting us in writing or by email.

Where we collect information, we will advise individuals for the purpose for which their personal information is collected.

If collecting sensitive information (as defined under the Act), we will treat it with the upmost security and confidentiality. We will ensure that it is not collected for any purposes other than those for which we have obtained the individual’s consent, unless the law requires otherwise, or other exceptional circumstances prevail as described under the Act. Where an individual chooses not to provide requested information, we will advise that individual of what consequences this non-disclosure may have. For example, withholding certain information may limit our ability to provide relevant treatment and services to individuals.

Your Personal Information may be disclosed in a number of circumstances including the following:

• if you consent to the use or disclosure, to communicate to other health professionals about your condition.

Security of Personal Information

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure.

How the information is held

Functional Pilates implements procedures to assure the integrity, accuracy and currency of staff (unrelated to employment records), customer and prospect customer records. All personal information and data is transferred, scanned and stored to an internal database system, securely protected by user login and password credentials. Client paper files are also stored offsite under lock and key.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

Access to your Personal Information

You may access the Personal Information we hold about you to update and/or correct it. If you wish to access your Personal Information, please contact us in writing. In order to protect your Personal Information we may require identification from you before releasing the requested information.

Maintaining the Quality of your Personal Information

It is important to us that your Personal Information is up-to-date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up-to-date or is inaccurate, please advise us as soon as possible so we can update our records and ensure we can continue to provide quality services to you.
